he legal consequences for construction work on a road or in the pavement area are severe in the event of an accident resulting in personal injury. Austrian law then provides for criminal convictions for the directly responsible site managers and foremen.
As a rule, administrative penalties are permanent offences that are punished on a daily basis. Minor deviations from traffic regulations constitute an administrative offence and add up to a fine of up to € 3,000 per construction site.

Although you need a permit in accordance with § 90 Straßenverkehrsordnung (Road Traffic Act) if you set up a construction site on a road or pavement and there are also specifications and rough guidelines on what is required to secure a construction site, however, this is not legally certain. This is exactly where the problems start for the companies carrying out the work! There is simply no binding specification in the STVO that would give every construction company a clear list of the necessary signage, construction fences and safety measures that they could adhere to.
95% of all construction sites in Austria are incorrectly signposted in terms of pedestrian safety and are not or insufficiently secured. Should an accident occur, it is usually the construction company that is on the thinner end of the stick, because it cannot, or can only with great difficulty, prove that it has taken ALL the NECESSARY safety measures, signage and safeguards to prevent the accident. The penalties are therefore almost always imposed on the construction company or the client.
